Can you make an amendment to a bankruptcy that is 3 years old? My husband forgot to put a judgment on the bankruptcy, or the lawyer did, I don’t know know. Now his ex wife is coming back to collect it but my husband thought it was included in the bankruptcy. Can we amend the chapter 7 bankruptcy?

; asked: Ok I don’t understand much about this at all, but I’m really curious.
If someone can’t pay their mortgage for whatever reason and their house is going for foreclosure and they file for bankruptcy, how long after it is DISCHARGED with the courts, do they have to move out of the house? approx? As in how long much longer can they stay before they have to move out?

Ironically I work for a bankruptcy attorney and I didn’t want to ask him because I’m already using him for the bankruptcy. I will check the contracts that I’ve signed and look up the laws.

I don’t want to pay the 3rd parties fees since I expect that I should be able to go directly and get the money just like the 3rd party company. Anyone know how to go about this?

I don’t want my credit ruined because my soon to be ex spouse is filing bankruptcy now. Divorce has been going on almost 3 years now, I want to stop him from filing on the house or anything else with my name on it, so I won’t be scarred for the next 10 years. The mortgage and home is in both of our names, but that’s about all, maybe one or two credit cards, but mostly the home. Anybody got good solid sugguestions?
I have already talked to an attorney, and get nothing but the run around. He won’t sign a quit claim deed, and cares nothing about the house. The attorney’s here are in a very tight knit circle where everyone knows everyone and has worked with them at one point in time. I don’t want my credit with a Bankruptcy lable on it because the ex is an idiot. The divorce has taken almost 3 years because he keeps putting it off. My parents are willing to support the children and myself, but he thinks he should get a cut in it. Just because they are well off, doesn’t mean I am. Any advice??

If an owner of a multi-unit apartment complex or a single-family home with tenants files chapter 7, what happens to the tenants before and after the discharge of the bankruptcy? Can they stay as long as they choose, considering they pay the utilities, or will the bank force them out? Of course, the new owners down the road may have a different plan, especially if its a single-family dwelling, but for the multi-units especially, couldn’t the tenants stay?

JV asked: I’m a creditor whose debt is secured by a real mortgage. I’ve received recently a notice that the debtor has filed for bankruptcy under chapter 7 of the US Bankruptcy code. What will happen to both my loan and my mortgage? Will I be enjoined from foreclosing the mortgage? The insolvent debtor by the way is an individual, not a corporation. Please prvide legal basis.
