I was told by an attorney that foreclosure and bankruptcy on a mortgage is 2 different things. I know that you can not apply for another mortgage for 5 years after a foreclosure and that after a bankruptcy you can apply in 18 - 24 months but does it make a difference if there was a mortgage involved in that bankruptcy. My mortgage was never reaffirmed after my bankruptcy neither.

I was wondering how soon I could apply for a home equity loan and get approved. My Ch. 7 Bankruptcy got discharged in June 2009 so it has been a year. I’m just wondering because I’m sure the laws keep changing. I was told the day after it gets discharged and then I was told two years after discharge. So, someone who actually knows please help?

For an FHA loan you have to wait two years after a bankruptcy, three years after a foreclosure, and three years after a short sale. What if you filed for bankruptcy AND had a short sale/foreclosure? Is it three years or two years? If this is addressed on the net somewhere, I would love a link.

Two people get a home loan, one goes full chaper 7 wipe out bankruptcy due to medical bills and major health issues. Co-borrower is determined to keep the home, and wants a loan modification. Does the bankrupt borrowers income still get counted even though that borrower is no longer legally responsible for the mortgage ?
NOTE: Borrower and Co-Borrower are NOT married.

I am recently divorced and left with two mortgages, credit card debt, student loans, a son to take care of, and no child support. If I can sell my house, I will be lucky to break even. I am considering bankruptcy and including my house to simply walk away and let the bank have the keys. I have a good job, but am so buried by debt right now I am living off credit cards. Currently all of my payments are current on the house and credit cards, but I can’t keep that up.

Understanding that bankruptcy does not include student loans, can anyone give me some advice on if this is the right thing to do? Additionally, would I then be able to purchase a small townhouse to move into with my son if my parents are willing to cosign the new mortgage with me?

-there is no equity in my home between the two mortgages. Zero.
- I have a child support order, but am not getting a dime
- I have just deferred my student loans for 6 months
