I went through a bankruptcy in 2008 where all my debt’s were wiped clean. I didn’t have to get put on a payment plan. (I don’t remember if that’s Chapter 7 or 11?) Anyway, I’ve heard it will come off your record after a certain amount of years. I’m a resident of Michigan - by the way. If you “surrender” the property, does it still count as a foreclosure against you? Does the bankruptcy protection, from either a Chapter 7 or 13, protect you from possible lawsuits etc?

I know many people view Chapter 7 as liquidation, but I have been told by many attorney’s you can also surrender in a 13 but people just opt not to.

Can they stay as long as they choose, considering they pay the utilities, or will the bank force them out? Of course, the new owners down the road may have a different plan, especially if its a single-family dwelling, but for the multi-units especially, couldn’t the tenants stay?
